Felony charges filed for Kenyan in Missouri who injures his own child

Automatic federal immigration hold ordered

Brian Kariuki, 20, of Creighton, MO, has been arrested and is in the Cass county jail in Harrisonville, MO accused of causing serious injury to a 3-month old infant.

The infant was taken to Childrens’ Mercy Hospital by the grand-mother after she noticed symptoms of what she thought were seizures.

Creighton, MO is 58 miles south-east of Kansas City, MO.Kariuki and his girlfriend lived in the basement of her mother’s house in Creighton, MO.

Because he is in the United States on a visa, an automatic immigration hold without bond has been placed upon his release from the county jail.

 On Wednesday, Cass County Pros­ecutor Teresa Hensely announced felony charges have been filed against a 20-year-old Creighton man for allegedly causing serious injury to a 3-month-old infant. Hensley said Brian Kariuki, who is in the Cass County jail with bond set set at $250,000, is charged with first-degree assault causing serious physical injury.

And according to Cpl. Kevin Tieman of the Cass County Sheriff’s Office, as a result of the criminal charges, Kariuki, who is from Kenya, Africa, and who is in the United States on a Visa, is being detained without bond on a federal hold for Immigrration Customs Enforcement.

Hensley said on Tuesday, the Cass County Sheriff’s Office was contacted by the Division of Children’s Services and informed a 3-month-old child had been taken to Children’s Mercy Hospital where it was discovered the child had several fractures.

Upon arrival the sheriff’s officer was informed the infant was having multiple seizures that were highly suspicious for child abuse. In addition, a Magnetic Response Imaging (MRI) had been conducted revealing bleeds and fractures.

Hensley said the defendant and the infant’s mother, Brandy Sites, currently live in the basement of her parents’ home, Kent Sites and Barbara Sites. The officer interviewed Barbara Sites who stated that on the morning of May 15, she had heard the infant crying for a long period of time. She allegedly told officers she went downstairs and found the defendant sleeping. Barbara Sites also told the investigator that she went downstairs again on the morning of May 16 after hearing the infant crying and again found the defendant asleep. Sometime after that the child began having seizures.

Hensley said the officer conducted an interview with the defendant, who previously had stated the infant fell off the couch and admitted there was a chance he shook the baby. Kariuki allegedly stated that at approximately 7 a.m. May 15, Judy Johnson, Brandy Sites’ grandmother, picked up the defendant at work with the infant in the car. Kariuki said he dropped Johnson off at her home and then went to his residence with his infant daughter. He stated he had not slept much the previous day and had worked seven days straight. He also stated he arrived home, changed and fed the infant and then fell asleep while feeding her. Kariuki stated the infant began crying and could not go to sleep because she had an ear infection. He stated he was cradling and rocking her in his arms standing up with his other arm around her ankles trying to calm her. The defendant stated the infant wouldn’t stop crying so he began rocking her harder. He said the longer she cried the faster he tried to shake her to get her to sleep. The defendant stated while shaking the infant he switched arms and held the infant out in front of him hanging onto her with both hands around her torso while shaking her.

He stated when she really started screaming he would shake her faster and harder and change arm positions. He stated he did this for about five minutes. The defendant stated the infant calmed down, he then fell asleep next to the infant. He stated Barbara Sites heard the infant crying, came downstairs and took the child upstairs. The defendant said when Brandy Sites came home, Barbara Sites told her the baby was acting somewhat different and they took the child to the hospital the next day because she was having seizures.

Hensley said on May 21, the sheriff’s office received an additional MRI report from Children’s Mercy Hospital which revealed numerous injuries and fractures that can all be explained as the result of inflicted trauma to the child, as well as injuries that are consistent with a shaken injury.
