ILLEGAL WORKER JAILED AFTER SEEKING LOAN WITH FALSE PASSPORT

An asylum seeker has been jailed for eight months after he was caught using a fake passport to try to open a bank account.

Bayo Hussain, aged 23, of Westbourne Drive, Tunstall, was told he couldn’t carry out unpaid work as an alternative to jail, because legally he should not be in Britain.

The Nigerian asylum seeker admitted possession of the forged passport, which he used at a bank in Tunstall last September to attempt to take out a bank account and a loan.

Prosecutor Neil Ahuja told Stoke-on-Trent Crown Court yesterday that at the time Hussain was unknown to immigration.

He said: “They had never heard of him entering the United Kingdom. He seemed to have no legal basis for being in the country. Since the offence, he has applied for asylum. The application remains pending.

“He tried to open a bank account in Tunstall using a forged passport. Staff were suspicious and the police were called. They seized the passport, which was in his name, and under examination it was found to be a forgery.

“He admitted using it to try to open a bank account, but not to knowing it was false. He claimed he got it for £50 from the Nigerian embassy.

“He said he entered the UK in 2003, having received a work visa from Nigeria. He made no comment as to how he worked.”

Patrick Thompson, defending, said: “This is someone who wants to work in this country. He has not thrown himself on the state.

“I accept that there is a certain inevitability of what is going to happen to him.

“He can’t do unpaid work when he shouldn’t be in the country.

“He is aware he is going to receive a custodial sentence. He’s prepared to face up to that sentence like a man.

“He has a partner in this country and he’s not made a nuisance of himself.”

Sentencing Hussain, Judge Paul Glenn told him: “You used a false passport to obtain work, to open a bank account, and. I understand, to take out two loans as well.

“You claim you didn’t know the passport was forged. I don’t accept that.

“You have made a conscious decision to try to stay in the United Kingdom when you know you have no right.

“Offences like this are serious and only custody is appropriate.

“As to whether you are ordered to leave the country after completing your sentence, I make no recommendation.”

Hussain was told he will serve no more than half of his eight month sentence.
